COMMON PROBLEMS FOR HEALTHCARE PROVIDERS

The problems that bring healthcare businesses to us

A private clinic carries the commercial risks of any business and a regulatory layer on top of them, and the two tend to arrive together. These are the six situations we are asked about most, and what each one turns on.

Regulated status changes the commercial questions rather than sitting beside them. Who the registered provider is, and what the registration covers, shapes the contract, the lease and the sale.

A new service may need registration Registration under the Health and Social Care Act 2008 regulations is per regulated activity, and the ones that catch private practice most often are treatment of disease, disorder or injury, diagnostic and screening procedures, and surgical procedures. Each is registered separately.
A clinician is engaged as self-employed Practising privileges, indemnity, supervision and who answers if something goes wrong. Status turns on how the arrangement actually operates rather than on the wording of the agreement.
Patient data has gone somewhere it should not Health data is special category data, so processing needs an Article 9 condition as well as a lawful basis. Retention, access and breach reporting are all tighter in practice than for ordinary business data.
The clinic is being sold or a partner is leaving Whether registration transfers or has to be applied for again, what happens to patient records, and which restrictive covenants survive the exit.
A marketing claim has been questioned Claims about outcomes, references to prescription-only medicines and before and after imagery are constrained by advertising rules and professional guidance as well as by consumer law.
A supplier or equipment contract has failed Warranties, maintenance and response times, and what happens to a service that cannot run while the equipment is down.
